RULES AND REGULATIONS
RETREAT 254 – RV RESORT

These Rules and Regulations apply to the use of the Retreat 254 – RV Resort located at 9630 E. US Highway 190, Rogers, Texas 76569 (the “Premises”), which is owned and operated by CECP Enterprises, LLC, a Texas limited liability company, doing business as Retreat 254 – RV Resort (“Retreat 254”). By using the Premises, you consent to the policies set forth herein and agree to abide by these Rules and Regulations at all times. In these Rules and Regulations, we sometimes refer to guests as “you” or “your” and to Retreat 254 as “we”, “us”, “our”, or “its”.
Our Commitment to Guest Safety and Comfort
These Rules and Regulations were developed as an extension of Retreat 254’s commitment to combine the highest-quality environment and services with the highest level of integrity in dealing with our guests and partners. The rules, regulations and policies set forth herein are designed to aide Retreat 254 in providing its guests a safe, secure, comfortable, convenient, and attractive environment. These Rules and Regulations will be continuously assessed to ensure guests’ needs are met and our commitments are upheld. You must report any problems or any incident or accidents to Retreat 254 immediately.
1. Acceptance of Rules and Regulations.
These Rules and Regulations constitute the entire and only agreement between us and you regarding the subject matter hereof, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to use of the Premises. These Rules and Regulations may be amended at any time and from time to time by us without notice to you. The latest Rules and Regulations will be posted on Retreat 254’s website (www.retreatrvresorts.com), and you should review these Rules and Regulations prior to using the Premises. Failure to do so is not grounds for exceptions to be granted. All guest agents, visitors and invitees of Retreat 254’s guests must be made aware of and abide by these Rules and Regulations; it is the responsibility of Retreat 254’s guests to ensure its visitors and invitees comply with these Rules and Regulations. ANY VIOLATION OF THESE RULES AND REGULATIONS IS GROUNDS FOR THE IMMEDIATE REMOVAL FROM THE PREMISES WITHOUT REFUND.
2. Office Hours, Emergency Contact.
Retreat 254’s office hours are from 9:00 AM to 6:00 PM, Monday through Friday, and 11:00 AM to 3:00 PM on Saturday. For after hours, you may contact (254) 231-2920 or email us at “[email protected]”, and we will do our best to assist you. FOR ALL EMERGENCIES, CALL “911”.
3. Admission.
Prior to the admission of any guest to stay on the Premises, a visual inspection of guest’s recreation vehicle (“RV”) by Retreat 254 staff is required. Only approved RVs are permitted on the Premises. Approved RVs include the following: Class A, B, and C motorhomes, fifth wheels, hard-sided travel trailers, and toy haulers. Cargo trailers, living quarter livestock trailers, and cab-over truck campers are not permitted. All RVs must be currently registered, fully self-contained, well-kept and in good condition, and in running order without leaks of any kind. Notwithstanding the foregoing, admission is subject to approval based upon year, condition, appearance and legal compliance. All RVs must be leveled and supported with proper equipment and be equipped with their own holding tank. RETREAT 254 RESERVES THE RIGHT TO DENY ADMISSION OF ANY GUEST OR PERSON FOR ANY REASON WHATSOEVER.
4. General Rules.
a) “Check-In” time is 1:00 PM on the day of your reservation.
b) “Check-Out” time is 12:00 Noon. NO REFUNDS FOR EARLY DEPARTURE.
c) A ten (10) MPH speed limit is strictly enforced.
d) Quiet hours are from 10:00 PM to 8:00 AM. During quiet hours and at all times, guests may not create or permit a nuisance or interfere with Retreat 254 or any neighbor’s use or enjoyment of the Premises.
e) A maximum of six (6) people, one (1) RV, and two (2) vehicles is allowed per campsite. Four (4) people are included in listed stay rates. Additional guests are $50 per person, per month.
f) You may NOT drive or park anywhere on the grass, doing so will result in a $25 fine.
g) Tent camping or sleeping in vehicles is not permitted.
h) Alteration to Resort 254’s electric, water, or sewer connections is strictly prohibited.
i) No sub-leasing of campsites is allowed.
j) NO OPEN CAMPFIRES ALLOWED AT ANY TIME. Manufactured outdoor cooking/charcoal grills and manufactured above ground fire pits are permitted so long as a proper fire arrestor is available within ten (10) feet of any open flame.
k) Solicitation or signs for the sale of products/services are not allowed.
l) No repairs or washing of vehicles or RVs is allowed on the Premises.
m) Criminal or drug related activity on the Premises will not be tolerated. No guest or their agents or invitees shall use, ingest, possess or distribute illegal drugs while on the Premises. Violation of this rule by a guest or their agents or invitees will result in immediate termination of their right to use the Premises.
n) Retreat 254 is not responsible for personal items that are lost, stolen or damaged while on the Premises.
5. Registration, Reservations, and Payment.
a) Registration and payment are due immediately upon arrival. No exceptions.
b) Reservations will only be held with payment in full; we will not hold a campsite without payment.
c) All payments are due in full on or before the designated payment date.
d) Any payment or partial payment not received after the fifth (5th) day of your designated payment date will result in the addition of a $40.00 late fee to the reservation. An additional $60.00 late fee (for a total of $100.00) will be added if an unpaid balance remains after the tenth (10th) day of your designated payment date. Any payment not received by the fifteenth (15th) day of your designated payment date will result in your removal from the property.
e) Payment methods accepted: Cash and/or Credit/Debit Card. Checks are accepted for monthly rentals only. Any checks returned for insufficient funds will result in a $24.00 processing fee.
f) No refunds within thirty (30) days of reservation; the only form of refund available will be credit for a future stay within one hundred-twenty (120) days of the original reservation.
g) After-hours check in is available on a case-by-case basis. For after-hours check-in, you must complete the New Camper Registration Form and make payment in advance in order to receive move-in instructions.
h) You agree to remove your RV from the Premises at the end of your stay.
6. Vehicle & Parking Rules.
a) One (1) RV and two (2) vehicles are allowed per campsite.
b) Vehicles may be parked in your assigned campsite only. Street parking, parking on grass, road shoulders, or vacant RV campsites is prohibited. Any vehicle parked in a vacant campsite without Resort 254’s approval will be charged for that campsite at the daily rate. Vehicle’s left unattended in a non-permitted space will be towed at the vehicle owner’s expense.
c) No boats, cargo trailers, utility trailers, or livestock trailers are allowed in or around the campsites.
d) Visitors may only park in the designated visitor parking spaces.
e) Golf carts are permitted for use on the Premises. Golf carts must adhere to these Rules and Regulations and abide by all state and local traffic laws and regulations. Golf carts must be well maintained and compliant with local laws.
f) MOTORIZED ATVS, DIRT BIKES, SIDE-BY-SIDES, OR OTHER UNLICENSED OR OFFROAD VEHICLES ARE NOT PERMITTED FOR USE ON THE PREMISES.
g) All persons operating any motorized vehicle on the Premises, including golf carts, must have a valid driver’s license to operate such vehicle.
7. Visitors.
Retreat 254 guests are permitted to have up to three (3) guests per day. Retreat 254 guests must accompany their visitors at all times. All visitors must check in at the front office. Any visitor that stays overnight or uses Retreat 254 facility must pay a $10/per day visitor fee. VISITORS ARE SUBJECT TO AND MUST COMPLY WITH THESE RULES AND REGULATIONS. ALL VISITORS MUST BE ACCOMPANIED BY A REGISTERED RETREAT 254 GUEST AT ALL TIMES.
8. Children.
Retreat 254 guests and their visitors are solely responsible for the safety and conduct of their children. Children under the age of 18 must have adult supervision at all times while on the Premises, including while inside the Retreat 254 Lodge, in all common areas, on all playground equipment and sport courts, around the pond, and in or around the swimming pool.
9. Campsite Cleanliness.
a) Guests agree to keep their campsite clean, neat, and attractive at all times.
b) All personal items must be stored out of sight when not in use.
c) Plants and temporary decoration are allowed if properly maintained and do not present a safety hazard or nuisance to other guests.
d) Normal outdoor items such as chairs, grills, and bikes are permitted to be kept outside in neat order.
e) No added temporary or permanent structures, clotheslines, freezers/refrigerators, fencing, barriers or pallets, dog kennels, pens or dog runs are allowed.
f) No tarps, mats, rugs, etc., allowed on the grass.
g) All water hoses/sewer lines must be free from leaks, and sewer hoses must have a “donut” or threaded attachment into the sewer, along with a sealing connection or rubber ring.
h) RV skirts are allowed if in good, proper working condition.
10. Trash.
Trash or refuge stored outside of your RV or anywhere on your campsite is not permitted. Any trash or refuge left outside or littered anywhere on the Premises or your campsite, including cigarette/cigar butts or pet waste, will result in a cleaning fee of $15 per occurrence. Outside trash cans are strictly prohibited. All trash must be taken to the designated dumpster on the Premises.
a) No large or bulky items, furniture, appliances, lumber, or metal may be left in or around the designated dumpster areas.
b) Do not throw cigarettes/cigar butts, drink bottles/caps, or charcoal anywhere on the Premises or in the pond.
c) Do not flush baby wipes, adult wipes, Q-tips or hygiene products down any toilet.
d) IT IS ILLEGAL TO DUMP GRAY OR BLACK WASTE ONTO THE GROUND. ALL PRECAUTIONS MUST BE TAKEN TO PREVENT ANY DISCHARGE OTHER THAN IN THE DESIGNATED/APPROVED SEWER LINES AND CONNECTIONS. IN THE EVENT OF AN ACCIDENTAL DISCHARGE GUESTS ARE REQUIRED TO IMMEDIATELY CLEAN THE WASTE AND NOTIFY RETREAT 254.
e) All campsites will be inspected by Retreat 254 before, during, and after move-out; a clean-up fee of $55 will be assessed if the campsite is left in less-than-desirable condition.
11. Behavior & Nuisances.
a) Excessive noise/nuisances created by guests, visitors, or children will not be tolerated.
b) Guests, visitors, and children must abide by quiet hours; an after-hour disturbance fee may be assessed for any calls received.
c) NO GENERATORS ALLOWED.
d) COMMON COURTESY SHALL PREVAIL BETWEEN ALL PERSONS ON THE PREMISES. OBNOXIOUS, PROFANE, ABUSIVE, OR THREATENING LANGUAGE, BEHAVIOR AND/OR ACTIONS DIRECTED AT RETREAT 254 PERSONNEL OR GUESTS, OR THAT COULD ADVERSELY AFFECT THE QUIET ENJOYMENT OF OTHER PARTIES UTILIZING OUR FACILITIES IS PROHIBITED. ANYONE ENGAGING IN SUCH ACTIVITY WILL BE REQUIRED TO LEAVE THE PREMISES IMMEDIATELY WITHOUT REFUND AT THE SOLE AND ABSOLUTE DISCRETION OF RETREAT 254.
12. Pet Policy.
a) No pets are allowed on the Premises that have a history of aggressive behavior. Retreat 254 reserves the right to refuse pets based on aggressive behavior.
b) All pets (dogs and cats) must be on a leash AT ALL TIMES unless inside the dog park.
c) Wildlife/farm animals are not allowed on the Premises.
d) No pets are allowed inside Retreat 254 Lodge, fenced-in amenity area, or the pool.
e) Two fenced dog parks are provided for you to exercise your pet. Please read and abide by the dog park rules.
f) Pet waste stations and complimentary bags are provided throughout the Premises.
g) All pet waste must be picked up and disposed of IMMEDIATELY. This includes around your campsite and anywhere within the Premises. This is a health issue for guests; noncompliance will result in a fine of $50 for each occurrence.
h) Animals are the exclusive responsibility of their owners. Noisy pets will not be tolerated.
i) Pets may not be left outside unattended.
j) If you are unable to control your pet, you will be asked to vacate the property.
k) Maximum number of pets allowed per campsite is two (2), unless approved in writing by Retreat 254 management.
13. Swimming Pool.
SWIM AT YOUR OWN RISK; NO LIFEGUARD ON DUTY.
a) Pool hours are 10:00 AM to 10:00 PM.
b) Use of the pool is subject to these Rules and Regulations and any other posted pool rules.
c) Children (15 and under) must be accompanied by an adult at all times within the pool area. Infants or children not toilet trained must wear protective swimwear.
d) No running, diving, jumping, smoking or use of glass containers or bottles is allowed in the pool area.
e) Any trash or refuge left behind in the pool area by guests is subject to a cleaning fee of $15.
f) CONSUMPTION OF ALCOHOLIC BEVERAGES IS NOT PERMITTED WITHIN THE POOL AREA.
g) RETREAT 254 MAY REFUSE PERSONS ADMISSION TO THE POOL AREA FOR ANY REASON OR NO REASON, AS DETERMINED IN ITS SOLE AND ABSOLUTE DISCRETION.
14. Workout Facility Use.
Children (15 and under) must be accompanied by an adult at all times within the workout facility. Use of the workout facility is at your own risk. Retreat 254 is not liable for any damages or injury resulting from the use of the workout facility.
15. Alcohol, Smoking, Drugs & Firearms:
a) CONSUMPTION OF ALCOHOLIC BEVERAGES IN COMMON AREAS IS STRICTLY PROHIBITED.
b) Dispose of smoking materials in proper receptacles. Do not throw cigarette/cigar butts, nor drink/bottle caps on the ground; this includes your campsite area.
c) Smoking is prohibited in any Retreat 254 building and within the pool area.
d) ABSOLUTELY NO DISCHARGE OR USE OF FIREARMS OR FIREWORKS IS ALLOWED ON THE PREMISES.
e) All weapons shall be kept in compliance with all applicable state and federal laws.
16. Pond Use, Catch and Release.
Fishing in ponds on the Premises is permitted in compliance with state fish and wildlife law. No fish caught may be kept for consumption or otherwise. SWIMMING IN THE POND IS STRICTLY PROHIBITED.
17. Damage to Retreat 254 – RV Resort Property.
Guests are responsible for all damage or destruction of Retreat 254 property, whether caused by the guest, their agents, guests, invitees, family, visitor, or pets. Such property includes but is not limited to, the amenities, restrooms, game room and gym equipment, pool, laundry facilities, utilities, electric/water/sewer hookups, landscaping, fencing, vehicles, streetlights, or signage. Retreat 254 reserves the right to charge guests accordingly for any damage they cause to the grounds and/or campground/resort facilities.
18. Right to Refuse or Limit Service.
Retreat 254 reserves the right to refuse service to anyone and/or limit the stay and number of persons per campsite.
19. Disclaimer and Limits.
RETREAT 254 ASSUMES NO RESPONSIBILITY FOR ANY PERSONAL INJURY, DEATH, LOSS OF PROPERTY, OR PROPERTY DAMAGE SUSTAINED WHILE ON THE PREMISES, INCLUDING WITHOUT LIMITATION, THAT RESULTS FROM FIRE, THEFT, VANDALISM, FALLEN/BROKEN TREES OR LIMBS, OTHER ACTS OF NATURE, ACTIONS OF UNSUPERVISED CHILDREN, OR ACTIONS OF OTHER GUESTS/VISITORS. ALL GUESTS AND VISITORS, AND THEIR HEIRS, PERSONAL REPRESENTATIVE, SUCCESSORS AND ASSIGNS HEREBY AGREE TO RELEASE, INDEMNIFY, DEFEND AND HOLD RETREAT 254, ITS OFFICERS, DIRECTORS, MEMBERS, MANAGERS, OWNERS, EMPLOYEES, AGENTS AND AFFILIATES (COLLECTIVELY, THE “RELEASEES”) HARMLESS FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, LIABILITY (INCLUDING ATTORNEYS’ FEES), ALLEGED OR ASSERTED AGAINST THE RELEASEES BY ANY GUEST OR VISITOR FOR ANY REASON. RELEASEES HAVE NO LIABILITY WHATSOEVER FOR YOUR USE OF THE PREMISES. IN PARTICULAR, BUT NOT AS A LIMITATION THEREOF, RELEASEES ARE NOT LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, LITIGATION, OR THE LIKE), WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE OR GROSS NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE NEGATION OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN US AND YOU. YOUR ACCESS TO AND/OR USE OF THE PREMISES WOULD NOT BE PROVIDED BY RETREAT 254 WITHOUT SUCH LIMITATIONS. NO INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM US SHALL CREATE ANY WARRANTY, REPRESENTATION OR GUARANTEE NOT EXPRESSLY STATED IN THESE RULES AND REGULATIONS.
ALL RESPONSIBILITY OR LIABILITY FOR ANY DAMAGES CAUSED BY YOUR ACCESS TO OR USE OF THE PREMISES IS DISCLAIMED. WE WILL NOT BE LIABLE TO YOU FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND THAT MAY RESULT FROM USE OF OR INABILITY TO USE OUR PREMISES. OUR MAXIMUM LIABILITY TO YOU UNDER ALL CIRCUMSTANCES WILL BE EQUAL TO THE PRICE YOU PAY FOR ACCESS TO OR USE OF THE PREMISES.
20. Miscellaneous.
These Rules and Regulations shall be treated as though they were executed and performed in Tarrant County, Texas, and shall be governed by and construed in accordance with the laws of the State of Texas (without regard to conflict of law principles). Any cause of action brought by you with respect to Retreat 254 must be instituted within one (1) year after the cause of action arose or be forever waived and barred. All actions shall be subject to the limitations set forth in Section 20 and this Section 21. The language in these Rules and Regulations shall be interpreted as to its fair meaning and not strictly for or against either party. All legal proceedings arising out of or in connection with these Rules and Regulations shall be brought solely in Tarrant County, Texas. You expressly submit to the exclusive jurisdiction of said courts and consent to extra-territorial service of process. If any provision of these Rules and Regulations is held invalid or unenforceable by any court of competent jurisdiction, the other provisions of these Rules and Regulations will remain in full force and effect. Any provision of these Rules and Regulations held invalid or unenforceable only in part or degree will remain in full force and effect to the extent not held invalid or unenforceable. Our failure to enforce any provision of these Rules and Regulations shall not be deemed a waiver of such provision nor of the right to enforce such provision.
